Filipino Health Care Agency (FHCA, Shirley Scheurer) is the operator of the website www.fhca.ch and therefore responsible for the collection, processing and use of your personal data. We take the protection of your privacy very seriously. This privacy policy provides you with information about which of your personal data we process, how and for what purpose we use, share and protect it. For reasons of better readability, the masculine form is used for personal names and personal nouns. All personal designations apply equally to all genders.
We process your personal data responsibly and comply with the applicable legal basis in accordance with the Swiss Data Protection Act (DPA) and the European General Data Protection Regulation (GDPR).
Data collection
Personal data is all information that can be attributed to a natural person. On the one hand, your data is collected when you provide it to us, e.g. when you contact us, submit an application or provide information in a personal exchange or as part of our business activities. On the other hand, we may collect personal data from clients and candidates and other persons involved as part of our business activities. In addition, data may be collected automatically by our IT systems when you visit our website. If this is necessary in the context of our business relationship, we may collect personal data from publicly accessible sources, e.g. from the debt collection register, the commercial register, other registers, websites or the media, but also from other companies and - with your consent - from former employers.
The transmission of your data is generally voluntary, unless a contractual obligation justifies this. However, we will have to collect and process the personal data that is necessary or legally required for the establishment and execution of a contractual relationship and for the fulfillment of the associated obligations. The processing of log data and certain other data when using this website cannot always be prevented.
Use of data
When you contact us (e.g. by e-mail or via a contact form), we collect, store and use the information you send us, such as your first and last name, your e-mail address, your telephone number, your address and the content of the message. If you send us an application dossier, in addition to your contact details you also provide us with personal data such as your CV (date of birth, nationality, marital status if applicable, salary expectations if applicable, professional experience) as well as further information on your education and training, qualifications and references. We primarily use this personal data to contact you, to process your request and to carry out our business activities, in particular to recruit and assess candidates and assign them to possible positions and assignments, to present potential positions to suitable candidates and to introduce suitable candidates to clients.
In addition, we also process personal data of you and other persons for the following purposes, where permitted and where we deem it appropriate, in which we (and sometimes third parties) have a legitimate interest corresponding to the purpose:
- Offer and further develop our products, services and websites;
- Communication with third parties and processing their requests;
- Examination and optimization of procedures for needs analysis for the purpose of direct customer contact and collection of personal data from publicly accessible sources for the purpose of customer acquisition;
- Advertising and marketing, provided you have not objected to the use of your data;
- Assertion of legal claims and defense in connection with legal disputes and official proceedings;
- Ensuring our operations, in particular IT and our website.
Insofar as the applicable law requires a legal basis for our processing of personal data, we rely in particular on the following principles:

Cookies and tracking when using our website
Log data
Our website is operated by www.all-inkl.com hosted. In order for the content of the website to be transmitted correctly to your device, our web servers may register non-personal usage data. This allows our web servers to obtain information about your devices, in particular the IP address assigned to your device. This data is only registered briefly for transmission purposes and is neither stored nor analyzed.
Cookies
Cookies are used on our website. Cookies are small files that are stored on your end device and saved locally by your browser. Some of the cookies we use are automatically deleted when you leave our website. Other cookies remain stored on your device until you delete them or until they expire. These cookies make it possible to recognize your browser the next time you visit our website. You have control over the cookies. Google Ads
We use the online marketing tool Google Ads from Google. This enables us to place targeted advertising within the Google network for marketing purposes in Austria, Germany and Switzerland and thus reach potential customers. Google Ads uses cookies to display ads that are relevant to users, to improve campaign performance reports or to prevent a user from seeing the same ads more than once. Google uses the cookie ID to record which ads are displayed in which browser and can thus prevent them from being displayed more than once. In addition, Google Ads can use cookie IDs to record so-called conversions that are related to ad requests. This is the case when a user sees a Google Ads ad and later visits the advertiser's website with the same browser and makes a purchase there. According to Google, Google Ads cookies do not contain any personal information.
Due to the marketing tools used, your browser automatically establishes a direct connection with the Google server. Through the integration of Google Ads, Google receives the information that you have called up the corresponding part of our website or clicked on an advertisement from us. If you are registered with a Google service, Google can assign the visit to your account. Even if you are not registered with Google or have not logged in, it is possible for Google to find out your IP address and store it. The legal basis for the processing of your data is a balancing of interests, according to which the processing of your personal data as described above does not conflict with any overriding interests on your part (Art. 6 para. 1 sentence 1 lit. f GDPR).
Google Ads is an offer from Google Ireland Ltd. based in Ireland, the recipient of the data is Google. Further information about Google Ads from Google, in particular how you can object to the use of your data by Google, can be found in Google's privacy policy.
Services from Facebook
We operate our own presence on Facebook for information, communication and marketing purposes and process data about you in this context. We process data about you via the platforms (communication, comments, likes and other functions) and receive non-personal data from the platform (analysis). When accessing Facebook, the terms and conditions and data processing guidelines of the respective operators apply.
A Facebook plug-in is also used on our website. When you access our pages with Facebook plug-ins, a connection is established between your browser and the Facebook servers. Data is already transmitted to Facebook in the process. If you have a Facebook account, this data can be linked to it. If you do not wish this data to be linked to your Facebook account, please log out of Facebook before visiting our site. Interactions, in particular the use of a comment function or clicking on a "Like" or "Share" button, are also passed on to Facebook. This so-called "Facebook pixel" is operated by Facebook Ireland Ltd. based in Ireland, and Facebook is also the recipient of the data. Data transfer to third parties
If it is necessary for the provision of our services to you, your personal data, including your application dossier and any other documents, will be passed on to clients (potential employers) with your express consent.
In order to achieve other purposes described in this Privacy Policy, it may also be necessary for us to disclose your personal data to the following categories of recipients: External service providers (e.g. IT service providers), business partners with whom we may need to coordinate the provision of services, and authorities. The transfer of personal data to third parties may also be necessary in order to assert an overriding legitimate interest or our legal claims. Your personal data will not be transferred to third parties for purposes other than those listed in this privacy policy or for the assertion of our rights without your express consent.
Your personal data is generally processed in Switzerland and the European Economic Area (EEA). However, we may also export or transfer personal data to other countries (e.g. to process it or have it processed there), provided that the local law guarantees adequate data protection in accordance with the decision of the Swiss Federal Council and the decision of the European Commission.
Data storage and data security
Personal data will only be stored for as long as is permissible and necessary to achieve the processing purposes, e.g. to provide our services. In the case of the placement of potential jobs, we retain personal data until the placement has been completed, i.e. until you have been successfully placed or you have revoked the placement order. We also retain your personal data for as long as is necessary to comply with legal retention and documentation obligations or for legitimate business interests (e.g. for evidence and documentation purposes) or if you withdraw your permission for us to store the data.
We take appropriate technical and organizational security precautions to protect your personal data from loss, misuse, unauthorized access, destruction or disclosure. To protect the security of your data during transmission, we use state-of-the-art encryption methods (SSL) via HTTPS.
Your rights
In principle, you have the right to information, correction, completion, deletion, restriction, data portability, objection and revocation with regard to your data. If we process your personal data, you can generally request information about our processing of your personal data free of charge, have the processing of your personal data restricted, have your personal data rectified, erased ("right to be forgotten") or blocked and object to the processing of your personal data. Please note that conditions and exceptions apply to these rights. To the extent permitted by law, we may refuse your request to exercise these rights.
You also have the right to withdraw your consent at any time with effect for the future. All you need to do is send us an informal e-mail.
In the event of a breach of data protection law or if your data protection rights have otherwise been violated in any way, you have the right to lodge a complaint with a competent data protection supervisory authority. The supervisory authority for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC, www.edoeb.admin.ch). If your habitual residence or place of work is in an EU member state, please contact the supervisory authority responsible for you.
